SC advises NCB over Rhea Chakraborty’s bail order in SSR drug case

NCB now requires Rhea Chakraborty’s bail order if they want to counter-attack Bombay High Court’s opposing remarks made in the judgement.

Rhea Chakraborty and her brother Showik Chakraborty’s drug nexus case has again caught up with proceedings. The case was filed last year and both siblings were arrested in the case after the Narcotics Control Bureau (NCB) had filed a 1200 page charge sheet in the case against 33 people. In a fresh hearing of the case on Thursday, the SC told NCB that they have to challenge the Bombay High Court order granting bail to actress Rhea Chakraborty in a drugs-related case if it wanted to assail adverse remarks made in the judgement. 

As per a report by PTI, a bench headed by Chief Justice S A Bobde noted the submission of Solicitor General Tushar Mehta, appearing for NCB, said that the probe agency was not pressing against the grant of bail to the actress. "You cannot challenge the bail order observations without challenging the bail order itself," said the bench comprising Justices A S Bopanna and V Ramasubramanian.

Notably, Rhea was granted bail on October 7 in 2020 by the Bombay High Court after the actress deposited a personal bond of Rs 1 lakh, however, her brother Showik’s bail petition was rejected. 

Rhea, meanwhile, has given assent on the charges that she received drugs at her residence since November 2019 and also procured drugs to Sushant for consumption. 

The NCB has pressed that Rhea had also financed the illegal trafficking of drugs and funded the same with her brother Showik’s help. Therefore, the probe agency has stated that Rhea Chakraborty conspired to procure, sell, transport, possess and both import and export interstate drugs.

Rhea has also been accused of trading with marijuana and ganja. The charge sheet states that not only Rhea but her brother Showik, Sushant's house manager Samuel Miranda, cook Dipesh Sawant, and another accused named Rishikesh Pawar procured and furnished drugs to Sushant Singh Rajput, who passed away on June 14, 2020. 

Rajput was found dead hanging at his Bandra, Mumbai residence that sent shockwaves across the country. His family had accused Rhea Chakraborty, Sushant’s girlfriend of encouraging him to commit suicide and also stealing a hefty amount from his bank account. However, Rhea said he was in depression and she was helping him with the treatment.
