Will International Court of Justice talk in favor of India’s Kulbhushan Jadhav?

The International Court of justice is yet to give the judgment on Kulbhushan Jadhav case and it is expected to happen on the 17th of July

Kulbhushan Jadhav is a retired Indian Navy officer, he was alleged of spying in Pakistan and was sentenced to death in April 2017. Soon after he was charged with the death penalty India approached the International Court of Justice in May. 

Since then India is fighting Pakistan for ignoring the consular access to Jadhav. Acting accordingly, the International Court of Justice bared a 4 day public hearing on the case in February. Both the lawyers from Pakistan and India proposed their pleas in the four-day public hearing.

The International Court of Justice stopped Pakistan's decision to execute Kulbhushan Jadhav to death on May 18, 2017.

Previously India argued and challenged Pakistan for a farcical trial against Jadhav. India is primarily fighting on two major issues: the breach of the Vienna Convention on Consular Access and their process of resolution.

On 25th December 2017 when Jadhav met his wife and mother they were completely ill-treated. His wife was asked to remove her ‘bindi’ and mangal sutra and his mother was asked not to speak in their mother language.

India condemned the ill-treatment of Jadhav family who was intimidated during their meet with Jadhav in Islamabad. India asked the International Court of Justice for his immediate release to the home country with all due respect. 

Pakistan referred Jadhav as a “spy” and said that he is not a businessman, they asserted that the security forces arrested him from the Balochistan on March 3 after he entered the place from Iran. 

India rubbished Pakistan statement and stated that Jadhav had his own business interests in Iran after he got retired from the force. And they also added that he was kidnapped from Iran.

Pakistan stated the reasons for rejecting India plea for consular and claimed that New Delhi wanted to get the information gathered by its “spy” which did not sound any fair for India.
